The Supreme Court will on Monday (today) hear the appeal filed by the Peoples Democratic Party (PDP) and its candidate in the 2018 Osun governorship election, Ademola Adeleke, challenging the judgment which affirmed the victory of Governor Gboyega Oyetola.
Onyechi Ikpeazu (SAN), Adeleke’s lead counsel, confirmed on Sunday that his team had received a hearing notice from the apex court.
Adeleke and the PDP approached the apex court to challenge the decision of the Court of Appeal sitting in Abuja, which affirmed the victory of Governor Oyetola at the poll.
The appellate court, in a majority decision of four to one, on May 9, 2019, overturned the decision of the Osun Governorship Election Tribunal, which nullified the victory of Governor Oyetola and declared Adeleke as winner of the election.
The three-man tribunal had, in a split decision of two to one, on March 22, 2019, proclaimed Adeleke as the governor-elect of the state.
But the lead judge, Justice Jummai Sankey alongside three other members of the appellate court panel, Justices Abubakar Yahaya, Isaiah Akeju and Bitrus Sanga ruled in favour of the appeal of Governor Oyetola and the All Progressives Congress (APC).
However, Justice George Mbaba ruled in favour of Adeleke and the PDP.
