Court Dismisses Busola Dakolo’s Suit Against Fatoyinbo, Fines Her N1m

A High Court in Bwari, Abuja, has struck out a case filed by Busola Dakolo, a celebrity photographer and wife of popular musician, Timi Dakolo, against Pastor Biodun Fatoyinbo of the Commonwealth of Zion Assembly (COZA),

 

Justice Oathman A. Musa, the presiding judge, dismissed the suit while delivering judgment on Thursday.

Dakolo had filed the suit against Fatoyinbo, claiming that the COZA pastor raped her 20 years ago when she was 16 years in Ilorin, Kwara State.

However, Fatoyinbo filed an objection and an affidavit at the Court reiterating that Busola’s statements were false and concocted to embarrass, scandalise and ridicule him.

Delivering judgment, Justice Musa concurred with the submissions of Fatoyinbo, noting that the case was empty and purely sentimental as it was aimed more at cruelty rather than obtaining justice.

The judge held that Dakolo’s case amounted to injustice and an abuse of judicial process and, therefore, dismissed the case.

The court also awarded costs of N1 million against Dakolo, noting that the fine should have been 10 times more because the court’s time was wasted.
